Welcome to Cajun Crossing Farm! By accessing our website or placing an order, visiting the farm, or using any of our services, you agree to abide by the following Terms and Conditions. Please read them carefully before using our site or purchasing any products.  

General Terms by using this website, you confirm that you are at least 18 years of age or have parental consent to make purchases. All content, including text, images, and products, is owned by Cajun Crossing Farm and may not be copied, reproduced, or used without written permission. We reserve the right to update these Terms and Conditions at any time without notice. Updates will take effect immediately upon publication.    

2. Product Information:
Products Offered: We offer a variety of high-quality garden products: Dahlia Tubers: Sold individually and priced per tuber unless otherwise specified. Rooted Cuttings: Available locally and subject to care instructions upon receipt. Seeds, Corms, Roots, Cuttings and Bulbs: Offered seasonally; please see specific product details on the website.  
Product Variability: tubers, roots, seeds, corms, cuttings, bulbs and other plant material may vary in size, shape, or appearance but are guaranteed to contain the DNA of the variety purchased. Minor blemishes or imperfections (e.g., peeling skin, bent necks) do not typically affect viability. We thoroughly inspect plants for viruses and diseases but do not perform lab testing on all stock. Viruses may be introduced by pests or environmental factors after leaving our farm.    

3. Order Placement Cart Items: 
Items in your cart are not reserved and may sell out before checkout is completed. Order Confirmation: Orders are only valid once payment is completed, and you receive a confirmation email. Customer Responsibility: Customers must ensure the accuracy of their shipping address, email, and order details. Errors may result in delayed or misdirected shipments.   

4. Shipping Policies:
General Shipping Policies: Shipping is only available within the United States. Customers are responsible for all shipping fees, which must be paid at checkout. Tracking information will be sent to the email provided. Ensure your email address is accurate. Once packages are handed to the carrier, Cajun Crossing Farm is not liable for delays, damage, or lost items. File claims directly with the carrier.  
Seeds, Corms, Roots, Tubers and Bulbs and other Plant Material: Shipping begins within one week of your purchase date or as specified at the time of purchase. In the event of a product delay, you will be notified by the email address provided at the time of purchase. Ensure any address changes are made prior to shipping. Returned packages due to incorrect addresses will incur an additional shipping fee. We are not responsible for issues caused by improper handling, storage, or planting after shipment.  
Weather Conditions Customers are responsible for monitoring local weather conditions before ordering. We are not liable for damage caused by extreme heat, frost, or other environmental factors during transit.   
 
5. Payment, Returns, Refunds, and Replacements:
Payment Terms: Payments are listed in USD and may vary seasonally. Full payment is required at the time of purchase or reservation. There is a $30 returned check fee. 
Refunds & Replacements Refunds are issued at our discretion and only after we have attempted to replace the product. Customers must notify us of any issues within 2 hours for cut flowers, 24 hours for tubers or 3 days for seeds, corms, and bulbs of delivery. Provide complete set photos or videos as evidence. Return shipping costs for defective items are the customer’s responsibility.  
Unforeseen Issues: If a product becomes unavailable for any unforeseen reason including storage failures, we will issue a refund or provide a replacement of a similar variety.  
Responsibility Disclaimer We are not liable for issues related to improper handling, storage, or planting after shipment.    

6. Cancellations & Order Changes Order Changes: 
Changes to existing orders (e.g., swapping varieties or altering quantities) cannot be accommodated. Combining Orders: Orders cannot be combined due to high order volumes and shipping complexity. Cancellations: Allowed only in extreme circumstances (e.g., severe illness or loss of home, with proof). A 20% restocking fee applies.  

7. Pick-UP, Delivery, Visiting Hours:
Pick-Up: Orders can be collected at the farm during scheduled prearranged pick up times. Please arrive at the scheduled time.
Delivery: Delivery is available to certain areas for an additional fee. Ensure accurate delivery details are provided. We are not responsible for missed deliveries due to incorrect information.
Visiting Hours: Visits are by appointment only or during scheduled events.

8. Code of Conduct: 
Customers are expected to communicate respectfully. Any rude, threatening, or abusive language will not be tolerated. We respectfully request the opportunity to resolve an issue with you promptly. Conduct: Visitors are expected to respect the property, flowers, and farm staff. Failure to comply may result in removal from the premises. Photography Policy
Photography on the farm is permitted for personal use only. At times, we may request that no cell phones be in use. 
Professional photography (e.g., for events, commercial use) requires prior written permission from Cajun Crossing Farm and may be subject to a fee. If authorization is granted, Cajun Crossing Farm reserves the right to have farm credit attached for professionally generated works. 

9. Intellectual Property:
All content, logos, and images on our website and social media are the property of Cajun Crossing Farm. Reproduction or use without permission is prohibited.

10. Privacy Policy: 
Your privacy is important to us. Please refer to our Privacy Policy for information on how we collect, use, and store your personal data.  

11. Force Majeure: 
We are not responsible for delays, cancellations, or losses caused by events outside our control (e.g., extreme weather, natural disasters, supply chain disruptions.)

12. Limitation of Liability: 
To the maximum extent permitted by law, Cajun Crossing Farm is not liable for any indirect, incidental, or consequential damages arising from your use of this site or purchase of our products. 
We are not responsible for issues caused by misuse, improper care, or environmental factors beyond our control.  
Visitors to the farm for all events will be required to sign a written waiver of liability for themselves and their minors, recognizing the inherent risks in visiting a working farm and agritourism. 
Children must be supervised at all times while visiting at Cajun Crossing Farm. 

13. Governing Law: 
These Terms and Conditions are governed by and construed in accordance with the laws of the state of Maryland, without regard to its conflict of laws principles.
